Gusto has announced general availability of Gusto Business Compliance, a service that registers, files and monitors the state and local compliance obligations that come with growing a small business, most notably hiring an employee in a new state. It is available now to all Gusto customers.

Because Gusto already runs a business's payroll and HR, it sees when the business hires across state lines, and Business Compliance acts on the registrations that follow. The service includes:

  • State tax registration with agencies such as the Department of Revenue and Department of Labor when hiring in a new state
  • Annual report filing to keep the business in good standing with the Secretary of State
  • Government mail monitoring: official notices, tax notices and rate changes tracked and resolved inside Gusto
  • Registered agent appointed in each state
  • Foreign qualification to legally operate in another state
  • Proactive compliance alerts for upcoming deadlines and new obligations
  • A Compliance Concierge Team of compliance experts for moments like expanding into a new state

"Small business owners shouldn't have to become compliance experts," said Alex Kehayias, Head of Gusto Business Compliance. "We built Gusto Business Compliance to help handle the paperwork, registrations, and filings required by states and local agencies, so they don't have to."

The launch comes less than six months after Gusto acquired Mosey, a compliance automation company. Gusto cites a survey in which half of small business owners said they spend too much time and money on compliance, and three in four said filing federal, state and local taxes was their most time-consuming compliance task.

Two more tiers: HR Partners and a PEO

Alongside Business Compliance, Gusto introduced Gusto HR Partners, which gives business owners direct access to a senior HR leader, a Gusto employee backed by a dedicated team, for help with hiring, onboarding and termination standards, benefits, total rewards and internal communications. It is available today to eligible customers, with broader availability coming soon.

Gusto PEO will take on much of the day-to-day work of payroll, benefits, HR and compliance, pooling small businesses to give them access to benefits and cost savings typically available to larger companies. Gusto says it will become available to eligible customers in the coming months.

Why it matters

Multi-state compliance is where small businesses most often slip when they start hiring remotely, and it has mostly been handled by separate registered-agent and compliance services. Gusto is folding it into payroll, where the trigger (a new-state hire) is already visible. With HR Partners and a PEO on top, Gusto now offers a ladder from self-serve payroll to co-employment, putting it in more direct competition with PEOs and HR-outsourcing providers for growing SMBs. Buyers comparing options should check which states and filings are covered and what the PEO will cost once pricing is published.
