Employment Law & ComplianceCalifornia Raises Repeat Pay Data Reporting Penalty to $1,000 per Employee
California Governor Gavin Newsom signed SB 1237 on September 30, 2026, raising the maximum penalty for a repeated failure to file a required pay data report from $200 to $1,000 per employee. The initial-failure penalty stays at $100 per employee. The higher cap applies to private employers with at least 100 payroll employees or 100 workers engaged through labor contractors, and takes effect January 1, 2027 — making the May 12, 2027 filing cycle the first subject to the steeper fine.
